What is an Expungement?
In Utah, when someone is granted an expungement for a conviction, records of that conviction are then sealed. After this happens, the individual is then lawfully allowed to answer "no" when asked if they have ever been convicted of a crime on applications for jobs, schools, housing, and loans.
When Can You Ask to Expunge an Arrest Record?
Accroding to Utah Code Section 77-40-104, you can ask to expunge your arrest record when there has been no conviction if:
- 30 days or more have passes since the arrest
- No criminal cases are pending
- Charges were filed but you were acquitted at trial
- Statute of Limitations has expired
What Crimes Cannot Be expunged in utah?
In the state of Utah, the following crimes cannot be expunged:
- assault
- domestic violence-related offenses
- DUIs
- sex offenses
- some weapons-related offenses
