What to Do If You Are Arrested for a DUI in Utah

When arrested for a DUI, we encourage full cooperation with the arresting officers. You will likely be subjected to a BAC test, either in the field in the form of a Breathalyzer or in the station through a blood test. Be polite and courteous, but we strongly recommend that you exercise your right to remain silent, speaking only to ask for a DUI attorney in Bountiful. Remember, too, that you are likely being videotaped through the officer's vehicle or uniform, which can work in your favor when it comes to court. In previous years, your trial would have depended on the testimony of the arresting officer and yourself; now, human memory can be compared to the evidence on these surveillance cameras.

If you have been charged with DUI in Utah, you could be facing serious penalties depending on the severity of your conviction. Depending on your blood alcohol concentration (BAC) level, age or previous convictions your charges may be subject to severe consequences that can change your life drastically.

Possible Penalties:

  • Jail Time
  • Monetary Fines
  • Ignition Interlock Device (IID)
  • Alcohol Education and Treatment
  • License Suspension
  • Vehicle Confiscation

The state of Utah takes driving under the influence very seriously and will prosecute accordingly. It is important that you gain the defense of an experienced Salt Lake City DUI attorney as soon as possible. At Collins Rupp, P.C., we are prepared to fight for your freedom.

Field Sobriety Tests

If you are pulled over in Salt Lake City for a DUI, the officer is going to perform one of the three The Standardized Field Sobriety Tests (SFST) :

  • Horizontal Gaze Nystagmus (HGN) test - In this test the officer will observe the eyes of the person as they slowly move a pen or small object back and forth to look for signs in each eye that the person is under the influence.
  • Walk-and-turn test - In this test, the officer instructs the person to take nine steps, touching heel-to-toe in a straight line and the return back. The officer is looking for signs that the person is impaired such as not being able to keep their balance or not following the instructions properly.
  • One-leg stand test - In this test, the officer instructs the person to stand with one foot off the ground and hold it or until told to put it down. The officer looks for signs of intoxication such as swaying, hoping or using their arms to balance.

Filing for a Hearing in Utah

You face the automatic suspension of your license if you don't file right away for a hearing. The state only provides a certain amount of days in which to file for this hearing, which is why we encourage quick contact with an experienced Salt Lake City DUI lawyer to make sure you've filed correctly and before the deadline.

During your hearing:

  • Your charges will be read
  • The arresting officer will give testimony
  • Your attorney can cross-examine the arresting officer
  • A Hearing Officer will come to a formal decision about your suspension

Having an attorney present to help facilitate your defense can make all the difference when it comes to the protection of your driving freedom.
