Utah Life Coach Arrested for Allegedly Selling Drugs to Clients

After receiving a tip from a confidential source that the life coach was growing and selling "magic" mushrooms, police raided a storage unit and the home of the woman.

More than 170 units of MDMA, 40 pills containing psilocybin (magic mushrooms), one bottle of LSD, and 10 units of DMT or dimethyltryptamine were found. Firearms were also found. The woman now faces charges of possession with intent to distribute and possession of drug paraphernalia. What are MDMA, Psilocybin, LSD, and DMT?

Since 1985, MDMA, LSD, Psilocybin, and DMT have been Schedule I substances both federally and under Utah law. However, in 2015, Utah downgraded possession for personal use of these drugs from a third-degree felony to a Class A misdemeanor. The important distinction here is that while possession for personal use is a Class A misdemeanor, sale or distribution is a felony offense.

MDMA is often known as Ecstasy or Molly and is a stimulant drug that can cause hallucinations. The drug is popular with teens and young adults who attend clubs, concerts, and rave parties.  LSD, also known as acid or Lucy, is a psychedelic drug that can affect a person’s thinking, sense of time, and emotions, often causing hallucinations. LSD is a synthetic chemical made from a substance found in ergot, which is a fungus that infects rye grains.  

Psilocybin is more commonly known as magic mushrooms and is a naturally occurring psychoactive compound found in more than 200 species of fungi. The drug acts on serotonin receptors in the brain linked to cognition and mood regulation. DMT is a serotonergic hallucinogen that occurs naturally in many plants and animals and is used in some cultures for ritual purposes. Both psilocybin and DMT are currently being studied as treatments for depression and other mood disorders.   

What Are the Penalties for Possession and Distribution of Hallucinogenic Drugs?

When MDMA, DMT, Psilocybin, or LSD are charged as possession for personal use as a Class A misdemeanor, the penalties include up to a year in jail and a $2,500 fine. A third charge for possession for personal use of these drugs becomes a third-degree felony with penalties of up to five years in prison, a $5,000 maximum fine, and a 90 percent surcharge.

If a person under the age of 18 was in the presence of a person possessing these drugs or if the drug was sent to a correctional facility, the penalties are enhanced. Enhanced penalties may also apply when the possession of these drugs occurs within 100 feet of a school, church, library, public park, preschool, recreation center, or amusement park. Distribution of these drugs is usually a second-degree felony. If convicted, the penalties include one to 15 years in prison and fines as large as $10,000.
