  • Sexual intercourse

  • Certain sexual acts involving the genitals

  • Touching done with the intent to arouse or gratify sexual desire

  • Touching done with the intent to cause emotional or bodily pain

Because the law lists this conduct so specifically, prosecutors have to show that what actually happened fits within one of these defined categories, not simply that an inappropriate relationship existed.
